Terms of use

These are the terms and conditions under which NetSpeedia.Net provides all wholesale Internet services ("service" or "services"). These Terms of Service act as a fully binding agreement between NetSpeedia.Net (herein "NetSpeedia.Net") and each of its customers (herein "Customer").

1. The ClientExec Hosting Automation Suite is located at: http://NetSpeedia.Net. NetSpeedia.Net shall primarily communicate with Customer through http://NetSpeedia.Net, and/or by electronic mail to the manager contact's e-mail address as specified by Customer within the hosting account. Notice of any events or changes involving Customer's service or this agreement shall be considered given at the time that such notice is posted in a prominent location within ClientExec, or is sent by e-mail to Customer.

2. NetSpeedia.Net will never sell or disclose Customer's contact information or customer lists to any third party, unless required by law or specifically authorized by Customer.

3. All customers must maintain the accuracy of their contact information within ClientExec. NetSpeedia.Net is not responsible for any inability by Customer to access or use ClientExec.

4. NetSpeedia.Net reserve the right to refuse service to anyone. Customers may only use our servers for lawful purpose. Transmission of any material in violation of any Federal, State or Local regulation is prohibited. This includes, but is not limited to copyrighted material, material legally judged to be threatening or obscene, and material protected by trade secrets. We expressly forbid anyone from using servers for the propagation, distribution, housing, processing, storing, or otherwise handling in any way lewd, obscene , or pornographic material, or any other material which we deem to be objectionable, including, but not limited to, pornography, satanic materials, and any and all materials of an adult nature. The designation of any materials as such described above is left entirely to the discretion of our management.

5. Payments are due monthly on the day that the Customer initially signed up, and NetSpeedia.Net dispatches e-mail invoices approximately seven (7) calendar days prior. If payment is not received by the due date, Customer's account will be suspended, and may incur a $50.00 reactivation fee at NetSpeedia.Net's discretion. Accounts may be deleted if they have spent eight (8) or more calendar days in a suspended state. Accounts past due may be subject to interest at the rate of 1.5% per month. If the customer do not want to continue with the services he needs to login into his account and delete all products/services, by doing this the customer will not be charge for late fees.

6. A $30.00 service charge applies to all returned checks, cashier's checks, or money orders.

7. Charges will be billed according to the price list currently in effect.

8. If any invoice or portion there of is disputed, the invoice must still be paid in full by the due date. Any credits issued in resolution of the dispute will be applied to the subsequent month's invoice.

9. Customer is responsible for complying with United States federal, state, and local laws, and applicable laws of any other countries with which Customer uses the Internet to communicate. Customer may not participate in or support any illegal activities through the use of their service. NetSpeedia.Net does not control the content of network traffic to or from their services or network.

10. Due to the insecure nature of much of the global Internet, NetSpeedia.Net strongly suggests that credit card numbers or other personal information never be sent through e-mail or any other Internet service, unless proper encryption is used. Customer is fully liable and responsible for the security and integrity of their own services, including Internet servers. NetSpeedia.Net will not be held liable for any security breaches that may occur. Customer agrees to fully indemnify and hold harmless NetSpeedia.Net from any legal or financial claims that may result from a breach in the security of Customer's services.

11. If any portion of this agreement is found to contradict federal, state, or local laws, the remaining portions will remain in full force. Any and all disputes regarding or resulting from this agreement will be governed by the laws and courts of Stillwater, Oklahoma.

12. We will not share your Personal Information with anyone without your prior permission nor will it be used for any other purpose than the purpose given. We will keep your Personal Information private and secure.
The information we collect from you allows us to provide you with information that is targeted specifically to you. You will have access complete access to your information in the event that you wish to make any changes or retract any of the information given.

Personal Information collected from users in countries of the European Union will be transferred to NetSpeedia.Net in the United States only with your proper permission, and in compliance with the United States Department of Commerce Safe Harbor Certification. We confirm that the data security practices that protect your Personal Information comply with all European laws on data protection and that you may exercise all rights accorded to data subjects under European laws.

Support boundaries

We know that providing support is a high priority task specially if you want to keep your current customers and attract new ones, that's the reason why we do our best and put great effort on making the best of our time invested in each case to properly respond to each of our customers and we put even more attention on solving their problems.

But as you might know there are times where a problem can slip around and go out of your hands, or times when you cant handle it anymore, and this specially happens when you are trying to support something that you cant directly interact with (customer keeps playing with the configs as you support him), have no access to (source code), or simply are not as familiar as you would like to be.

That is why we must to set support boundaries so that we know that we always resolve issues or respond to questions properly.

How does this work? It’s simple -- if it’s within our support scope we can fix it. If it's not, we will try to guide the customer but will not directly interact with the issue. This maintains your relationship with your customer, and at the same time keeps us from making any irreversible damage to your applications.

We will always support connectivity issues, DNS issues, and anything that has to do with the network, but what we can not provide support to is:
Scripts of any kind, or any service modifications (HTTP, HTTPS, FTP, etc.)

We do not support scripts because as much as we would like to, we know that there are lots of web scripting languages over the network, and we know that we should not mess with the customer code for it could make it unstable or unsafe, its always better to keep this with a full time developer or consultant.

We do not support services modifications because this might lead to security flaws, and end up on malfunctioning services that anyone can take advantage of, services not working or running at all and more importantly it would mean security vulnerabilities that would place in jeopardy your sites integrity and a giant downtime.

Although we do not provide support for this we will always make ourselves useful by investigating the issue, finding a way to solve and inform the customer about our findings, if we can not fulfill this task we can get you in touch with an expert or consultant trough our channels, this usually means an additional cost but it definitely means a fix for that particular issue that might be bugging you.

Security Policies

We are concerned about our customer's business security; outdated operating systems and outdated/mis-configured services are commonly the target of many crackers across the internet, this is why we provide Dedicated Servers with the latest Operating Systems, latest services, and the latest patches and updates.

Keep in mind that every day a new vulnerability on a service or Operating System is discovered, and this could make your server a direct target for an attacker. While we do keep the server(s) updated/patched as available, these patches (generally) do not apply to a domain-level. Individual scripts on individual domains are maintained by the author, so patches and updates will be provided by the author. The security we maintain on the servers is at an operating system and service level.

If one of our customer’s servers is compromised at any level, we can restore the data from the most recent backup(s). Our policy is an immediate OS re-install on any compromised server, as they are a threat to our network, to the rest of our customer servers, and to different other networks or servers around the world. As soon as we find that a server has being compromised at any level, we will proceed to disconnect that server and to notify the customer.

An OS reinstall has a price of $100 and will be performed as requested and will enter a line or queue, this means, that if your request is the last one to enter it will be the last one to be ready or if it was the first one received it will be the first one to be ready (FIFO, First In, First Out).

If your server for any reason start compromising other networks, our network, or other servers or computers the customer will be directly responsible and will have to pay the fine that the appropriate authorities assign to this compromise, and in the case of the ip address being black listed by this compromise we can not be responsible of taking the customer out of this blacklist, the customer will have to contact the blacklisting site and find out what has to be done to get his ip out of their list and pay for this process to take place.

DomainGurus will also fine $200 for having this ip address blacklisted, when this address was given to the customer it was not on any list (this may vary, please read our IP security policy).

Security & Responsibilites

Security is an important part of your Internet-based business, and it is important that our customers understand the security policies we apply to the servers at NetSpeedia.Net. Every server our customers sign up for is built using our latest operating system builds, and contain the latest vendor-supplied patches.

However, as we do not maintain control over the actual operating system, we do not claim responsibility for our customer's domains. Keeping the security of a server up-to-date is a continuing task, and is the responsibility of the customer.

While our builds provide the initial security to keep your company secure, new security problems arise with all server types every day, and we cannot maintain the security of all of the systems operated by our customers. The only exception to this case is servers that are directly maintained by our company, to which the customer does not have shell access. NetSpeedia.Net will maintain the security on these systems.

In the event of a system compromise on a host we are not maintaining, it is the responsibility of the customer to back-up his data and contact us to take action. Our policy is to immediately re-install any compromised servers on our network, as they pose a threat to all of our systems. We can perform a re-install for a $100 consulting fee. The typical downtime during one of these re-installs is about ten minutes.

IRC activity

We discourage IRC activity on the NetSpeedia.Net network because it attracts network attacks far more than any other activity. If your server is attacked or is used to attack other hosts - and is found to be running IRC, NetSpeedia.Net may disconnect your IRC server and require you to supply a $500 security deposit to cover costs associated with future network attacks. At the end of your term of service with NetSpeedia.Net (or if you discontinue IRC activity), we will refund the deposit if there have been no network attack incidents. We don't maintain:
* Hosts connected through us, via T-1, T-3, or Dial-up.

As a provider of Internet/World Wide Web access, web site hosting, and other Internet-related services, NetSpeedia.Net, INC. (“NetSpeedia.Net”) offers its customers, the means to acquire and disseminate a wealth of public, private, commercial, and non-commercial information. NetSpeedia.Net respects that the Internet provides a forum for free and open discussion and dissemination of information, however, when there are competing interests at issue, NetSpeedia.Net reserves the right to take certain preventative or corrective actions. In order to protect these competing interests, NetSpeedia.Net has developed this Acceptable Use Policy (“AUP”), which supplements and explains certain terms of each customer's respective service agreement and is intended as a guide to the customer's rights and obligations when utilizing NetSpeedia.Net’s services. This AUP will be revised from time to time. A customer's use of NetSpeedia.Net's services after changes to the AUP are posted on NetSpeedia.Net's web site, http://www.NetSpeedia.Net under the Legal Details section, will constitute the customer's acceptance of any new or additional terms of the AUP that result from those changes. One important aspect of the Internet is that no one party owns or controls it. This fact accounts for much of the Internet's openness and value, but it also places a high premium on the judgment and responsibility of those who use the Internet, both in the information they acquire and in the information they disseminate to others. When subscribers obtain information through the Internet, they must keep in mind that NetSpeedia.Net cannot monitor, verify, warrant, or vouch for the accuracy and quality of the information that users may acquire. For this reason, the user must exercise his or her best judgment in relying on information obtained from the Internet, and also should be aware that some material posted to the Internet is sexually explicit or otherwise offensive. Because NetSpeedia.Net cannot monitor or censor the Internet, and will not attempt to do so, NetSpeedia.Net cannot accept any responsibility for injury to its users, customers or subscribers that results from inaccurate, unsuitable, offensive, or illegal Internet communications. When users, customers or disseminate information through the Internet, they also must keep in mind that NetSpeedia.Net does not review, edit, censor, or take responsibility for any information its users, customers or subscribers may create. When users place information on the Internet, they have the same liability as other authors for copyright infringement, defamation, and other harmful speech. Also, because the information they create is carried over NetSpeedia.Net’s network and may reach a large number of people, including both customers and subscribers and non-subscribers of NetSpeedia.Net, customers’ and subscribers' postings to the Internet may affect other customers and subscribers and may harm NetSpeedia.Net's goodwill, business reputation, and operations. For these reasons, customers and subscribers violate NetSpeedia.Net policy and the service agreement when they, their customers, affiliates, or subsidiaries engage in activities described herein.

Scope:
This AUP governs the usage of NetSpeedia.Net's products and services (the "Services"). This AUP is incorporated by reference into each contract NetSpeedia.Net enters into with a customer (each, a "Customer") for the use of such Services. NetSpeedia.Net may modify this AUP at any time without notice. In addition, this AUP is incorporated by reference into the Terms of Service applicable to NetSpeedia.Net's Web site so that no person who utilizes NetSpeedia.Net's Web site (regardless of whether that person is a Customer) may take any action utilizing NetSpeedia.Net's Web site that a Customer would be prohibited to take utilizing the Services.

Purpose:
The purpose of this AUP is to enhance the quality of the Services and to protect NetSpeedia.Net's customers, and the Internet community as a whole, from illegal, irresponsible, or disruptive Internet activities. This AUP applies to each Customer and its employees, agents, contractors or other users of such Customer who obtain Services from NetSpeedia.Net (each such person being a "User"). Each User should use common sense and good judgment in connection with the Services. Parents or guardians should always supervise minors in using the Internet. Parents and guardians should remain aware at all times of what is on the Internet and how the minors under their care are using the Services and the Internet.

Prohibited Uses:
Customers and Users may not:

    • Utilize the Services to send unsolicited bulk and/or commercial messages over the Internet (known as "spamming"). It is not only harmful because of its negative impact on consumer attitudes toward NetSpeedia.Net, but also because it can overload NetSpeedia.Net's network and disrupt service to its Customers subscribers. Also, maintaining an open SMTP relay is prohibited. When a complaint is received, NetSpeedia.Net has the absolute and sole discretion to determine from all of the evidence whether the email recipients were from an "opt-in" email list.
    • Utilize the Services in connection with any illegal activity.
    • Utilize the Services to copy material from third parties (including text, graphics, music, videos or other copyright material) without proper authorization;
    • Utilize the Services to misappropriate or infringe the patents, copyrights, trademarks or other intellectual property rights of any third party;
    • Utilize the Services to traffic in illegal drugs, illegal gambling, obscene materials or other any products or services that are prohibited under applicable law;
    • Utilize the Services to export encryption software to points outside the United States in violation of applicable export control laws;
    • Utilize the Services to Forge or misrepresent message headers, whether in whole or in part, to mask the originator of the message; or
    • Utilize the Services in any manner that violates applicable law.
    • Utilize the Services in connection with any tortuous or actionable activity. Without limiting the general application of this rule, Customers and Users may not:
      • Utilize the Services to publish or disseminate information that (A) constitutes slander, libel or defamation, (B) publicizes the personal information or likeness of a person without that person’s consent or (C) otherwise violates the privacy rights of any person. Utilize the Services to threaten persons with bodily harm, to make harassing or abusive statements or messages, or to solicit the performance of acts or services that are illegal under applicable law.
      • Utilize the Services in connection with any other disruptive or abusive activity. Without limiting the general application of this rule, Customers and Users may not:
        • Utilize the Services to cause denial of service attacks against NetSpeedia.Net or other network hosts or Internet users or to otherwise degrade or impair the operation of NetSpeedia.Net’s servers and facilities or the servers and facilities of other network hosts or Internet users;
        • Post messages or software programs that consume excessive CPU time or storage space;
        • Utilize the Services to offer mail services, mail forwarding capabilities, POP accounts or auto responders other than for the User’s own account;
        • Utilize the Services to resell access to CGI scripts installed on NetSpeedia.Net’s servers;
        • Utilize the Services to subvert, or assist others in subverting, the security or integrity of any NetSpeedia.Net systems, facilities or equipment;
        • Utilize the Services to gain unauthorized access to the computer networks of NetSpeedia.Net or any other person;
        • Utilize the Services to provide passwords or access codes to persons not authorized to receive such materials by the operator of the system requiring the password or access code;
        • Utilize the Services to (A) forge the signature or other identifying mark or code of any other person, (B) impersonate or assume the identity or any other person, or (C) engage in any other activity (including "spoofing") to attempt to deceive or mislead other persons regarding the true identity of the User (excluding the use of anonymous re-mailers or Internet nicknames);
        • Utilize the Services to distribute or post any virus, worm, Trojan horse, or computer code intended to disrupt services, destroy data, destroy or damage equipment, or disrupt the operation of the Services;
        • Utilize the Services to conduct port scans or other invasive procedures against any server (except any server for which the User is an authorized system administrator);
        • Utilize the Services to distribute, advertise or promote software or services that have the primary purpose of encouraging or facilitating unsolicited commercial e-mail or Spam;
        • Utilize the Services to solicit or collect, or distribute, advertise or promote, e-mail address lists for the purpose of encouraging or facilitating unsolicited commercial e-mail or Spam;
        • Utilize the Services in any manner that might subject NetSpeedia.Net to unfavorable regulatory action, subject NetSpeedia.Net to any liability for any reason, or adversely affect NetSpeedia.Net’s public image, reputation or goodwill, including, without limitation, sending or distributing sexually explicit, hateful, vulgar, racially, ethnically or otherwise objectionable materials as determined by NetSpeedia.Net in its sole discretion; or
        • Utilize the Services in any other manner to interrupt or interfere with the Internet usage of other persons.

Violations:

    • Disclaimer. NetSpeedia.Net expressly disclaims any obligation to monitor its Customers and other Users with respect to violations of this AUP. NetSpeedia.Net has no liability or responsibility for the actions of any of its Customers or other Users or any content any User may post on any Web site.
    • Reporting Non-Copyright Violations. NetSpeedia.Net encourages Users to report violations of this policy by e-mail to: This e-mail address is being protected from spam bots, you need JavaScript enabled to view it , including in any such report the name of the offending domain (for example, xyz.com) and the type of abuse (for example, Spam, illegal acts, harassment, etc.) in the "subject" field of the e-mail.
    • Reporting Copyright Violations. NetSpeedia.Net complies with the Digital Millennium Copyright Act ("DMCA"). NetSpeedia.Net encourages Users to report an alleged copyright infringement involving a user by sending a notice that complies with the DMCA which information is located under the Legal section of this website.
    • Remedies. If NetSpeedia.Net learns of a violation of this AUP, NetSpeedia.Net will respond to the applicable Customer and may, in NetSpeedia.Net’s sole discretion, take any of the following actions, in accordance with the severity and duration of the violation:

      • Warning the Customer;
      • Suspending the offending Customer from the Services;
      • Terminating the offending Customer from the Services;
      • Imposing fees or charges on the offending Customer account in accordance with the applicable service contract;
      • Removing the offending content; and
      • Taking other action in accordance with this AUP, the applicable service contract or applicable law.

Reservation of Rights:
NetSpeedia.Net reserves the right to cooperate with appropriate legal authorities in investigations of claims of illegal activity involving NetSpeedia.Net’s Services, Customers and other Users. NetSpeedia.Net reserves all other rights to respond to violations of this AUP to the extent of applicable law and in accordance with any applicable contractual obligations. NetSpeedia.Net may utilize technical means to monitor communications into, and out of, its network facilities to prevent the introduction of viruses or other hostile code, to prevent intrusions and otherwise to enforce this AUP and each Customer agrees that NetSpeedia.Net is authorized to monitor its communications through NetSpeedia.Net's network for such purposes.
